Estate Recovery

Established under federal law, this program requires the Alabama Medicaid Agency to recover costs paid by the Agency from the estates of deceased Medicaid recipients.

Probate Cases

Alabama law (Act 2019-489) requires the personal representative or person filing the small estate case to provide notice of the estate to the Alabama Medicaid Agency. 

The Estate Notice Office was created to respond to notices at the commencement of a probate proceeding.

This office will process all valid notices within 30 days from the date of receipt.

The Estate Recovery Unit is responsible for recovering the costs paid by the Agency from sources other than the probate estate.
